Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrustPulse Review Shopify app ("the app", "we", "us"). By installing or using the app, you agree to these Terms. If you do not agree, do not install or use the app. Your use of the app is also subject to Shopify's terms and policies applicable to your Shopify account.

1. The service

TrustPulse Review lets Shopify merchants collect, moderate, and display product reviews, show ratings and verified-purchase badges on their storefront, and send review-request emails to customers after an order is fulfilled. Features available depend on your plan.

2. Plans, billing, and trial

• The app offers a free Basic plan and paid Plus and Advanced plans. Paid plans include a free trial as shown at checkout.
• All billing is handled by Shopify through its managed app billing. Charges appear on your Shopify invoice, and Shopify manages trials, upgrades, downgrades, and proration.
• You can cancel at any time by uninstalling the app; cancellation stops future charges in line with Shopify's billing terms. Fees already billed are non-refundable except where required by law.

3. Acceptable use

You agree not to use the app to:

• Publish false, misleading, or fraudulent reviews, or manipulate ratings.
• Send unsolicited email in violation of applicable anti-spam laws.
• Upload unlawful, infringing, or harmful content.
• Interfere with, disrupt, or attempt to gain unauthorized access to the app or its infrastructure.

4. Merchant responsibilities

• You are responsible for complying with all laws that apply to your store, including consumer-protection, privacy, and email/marketing laws.
• You are responsible for moderating the reviews displayed on your storefront.
• You must obtain any consent required to contact your customers by email.
• You are the controller of your store and customer data; we process it on your behalf as described in our Privacy Policy and Data Processing Agreement.

5. Data processing

Where we process personal data on your behalf, that processing is governed by our Data Processing Agreement (DPA), which is incorporated into these Terms. By using the app you agree to the DPA.

6. Intellectual property

The app, including its software, design, and content we provide, is owned by us and our licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the app while installed. Content you or your customers submit remains yours.

7. Disclaimer

The app is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the three months before the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless TrustPulse Review and its operators from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the app; (b) your violation of these Terms or any law; and (c) the content of the reviews or other material you publish, moderate, or send using the app, including any claim that such content is false, misleading, infringing, or unlawful.

10. Termination

You may stop using the app at any time by uninstalling it. We may suspend or terminate access if you breach these Terms or use the app in a way that risks harm to us, our providers, or others.

11. Modifications to the service

We are continually improving the app and may add, change, or discontinue features from time to time. For material changes or the discontinuation of a significant feature, we will provide reasonable notice where practicable. We are not liable to you for modifying or discontinuing any part of the app.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in Jaipur, India will have non-exclusive jurisdiction over any dispute arising out of or relating to these Terms or the app. This does not prevent either party from bringing proceedings in another competent jurisdiction where required or permitted by applicable law.
